The fact is, there is nothing legally that says the could not do so. There is no legal category "Single barrel".

I think Chuck Cowdery has addressed that point in the past but I can't remember what he said! Anyway I personally don't think it matters much what practice in this regard is followed or how distillers interpret these things. It is a very regulated business so I am sure they are as careful as they need to be.

True, but taking bourbon out of one barrel to top off another means there are TWO barrels. This has to violate the spirit if not the letter of the term "single barrel."

BTW, Jacob's Well never identified itself as single barrel, only "small-batch microdistilled" nonsense.
